After an Injury

If you have been injured on the job, you must notify your employer in writing within four working days. If your employer has designated a doctor to treat work-related injuries, you must see that doctor in order for workers' compensation to pay the bills. Your employer must notify the insurance company of the injury within 10 days.

If your claim in denied, you have 45 days to file an application for a hearing to dispute the denial. We can represent you at this hearing or at any step in the process.

The Benefits

Injured workers have a right to receive payment of their medical expenses and a portion of their wages while they are unable to return to work. Temporary disability benefits differ for temporary partial disability (TPD) and temporary total disability (TTD). Workers' comp also pays various sums for three different types of permanent disabilities. If you are awarded permanent disability payments, we can help you receive a lump sum payment rather than weekly benefits. Survivors of those who died on the job are eligible to receive funeral expenses of $7,000 in addition to a death benefit.

Third Party Claims

Because we offer comprehensive legal services to injured people, our attorneys will analyze your case to determine whether you can file a third party claim against someone other than your employer. Under the Colorado Workers' Compensation Act, employees cannot sue their employers. You can, however, pursue financial compensation from someone else, for example, the driver of a car that hit you while you were driving as part of your job.

If you have suffered a job-related injury or developed an occupational illness, please contact the Frickey Law Firm today. We fight for the rights of injured workers.
