  • Wrongful Death Suit Against Discovery is Amended

    A lawsuit claims that Discovery Communications Inc., the parent company of Discovery Channel, is responsible for the June 2012 death of a Colorado woman. The wrongful death suit was originally filed in June of this year but was recently amended. It has grown from six claims to ten and has added two of the husband’s brothers as plaintiffs. Discovery and Anthropic Productions Corp. have until the middle of this month to respond to the lawsuit.

    The 51-year-old woman lost her life during the filming of a show centering on her husband’s 87 military vehicles and weapons. The two owned a firing range and gun store in Colorado Springs, Colorado, as well as a military museum where many of the items would have been showcased on the show were located. According to the woman’s husband, a one-year contract had been signed between the family and the defendants. During the filming, the production company planned to have the family – newly added plaintiffs included — walk through a cloud of smoke carrying weapons. But during this sequence, a pyrotechnic device went off and collided with the 51-year-old. She died due to the injuries she suffered.

    In the wrongful death suit, the plaintiffs claim the defendants knew the devices used had not been made by a licensed and experienced manufacturer. The lawsuit goes on, claiming the companies did not have permits to use the devices. In the claim, the plaintiffs said the two devices shot at the store personnel “like missiles.” The suit seeks unspecified damages for negligent infliction of emotional distress and wrongful death. It is unclear how much the family could win in this case, but it serves to remind individuals who have suffered the unexpected loss of a loved one of one of the many ways that they can seek recourse against a responsible party.
