I want to start by giving such a big Thank You to Erin, Stefani and Anastasha for helping me get through one of the most difficult times in my life. They helped me with a workman’s comp case I had due to slipping on black Ice in January of 2023 due to breaking my tibia, fibia and ankle. I have never experienced such a traumatic break, thanks to Anastasha for introducing me to the Frickey Law Firm. These ladies are truly amazing, make you feel heard, get you what you lost but most of all they treat you like family. Amazon Is a Known Dangerous Workplace

Amazon is known for maintaining a hazardous workplace that results in countless injuries to its workers. The rate of injuries at Amazon warehouses is more than double that of the industry. Each year, 6.6 out of every 100 Amazon workers will be seriously injured on the job. Many will need medical treatment and be forced to miss time from work.

In 2023 the U.S. Department of Labor announced that the Occupational Safety and Health Administration (OSHA) has cited Amazon for safety violations including the warehouse located  in Aurora, Colorado. OSHA found that Amazon had failed to provide safe workplaces, violating the Occupational Safety and Health Act’s general duty clause. The violations involved exposing workers to ergonomic hazards, significantly increasing the risk of musculoskeletal disorders like low back injuries. Key issues included the frequency and weight of packages workers must lift, awkward body movements, and the long hours required to complete tasks.

OSHA’s review of on-site injury logs showed high rates of musculoskeletal injuries among Amazon warehouse employees. As a result, OSHA proposed $46,875 in penalties for the violations at the Aurora, Nampa, and Castleton facilities. Hazard alert letters were issued to Amazon, emphasizing the need for safer working conditions to protect warehouse employees from further risk.

Amazon has strict quotas and zero tolerance for workers who do not meet them. Amazon always tracks its workers’ productivity to get the most out of them and to let them know they are being watched. Amazon claims that it has taken steps to improve workers’ safety, which is continuously improving, although the numbers tell a different story.

Warehouse workers are not the only ones at risk. Although Amazon outsources most of its deliveries (if injured you still have a claim against the outsourced delivery company) the company still employs some drivers to make same-day and one-hour deliveries. These drivers are also under a lot of pressure to meet ambitious delivery schedules.

Common Injuries for Amazon Workers

Because of the physical labor involved, Amazon workers may suffer the following injuries:

  • Lower back injuries from lifting
  • Shoulder injuries
  • Musculoskeletal disorders
  • Slip and fall
  • Overuse injuries, such as tendonitis and bursitis
  • Sprains and strains
  • Torn ligaments
  • Occupational illnesses

So long as you can prove that your injury or illness was job-related, it would help if you qualified for workers’ compensation benefits. Workers’ comp is a no-fault system, and you can still receive benefits for an injury unless you act intentionally.

What Should I Do After Being Injured on the Job for Amazon?

Amazon Workers’ Compensation ClaimsIf you work for Amazon and suffer a job-related injury, you may be entitled to workers’ compensation benefits. The first thing that you must do is notify your employer of the injury. You have only ten days to report your injury to your employer, and you must give them written notice within this time or risk a penalty for failing to timely report your injury.

Once you report your injury, your employer is supposed to provide you with a list of up to four doctors within close proximity to you, and you can choose one on the list to diagnose and treat your injuries. If your employer does not provide a list of at least four doctors, you can select a doctor to treat you for your work injuries.

You should contact The Frickey Law Firm TODAY at 303-237-7373 to discuss your claim, your legal rights and potential compensation. There is no risk and fee to you unless we are successful with your claim.

You can also file a workers’ compensation claim with the Colorado Department of Labor and Employment. You have two years from the date of your injury to file your claim, but there is no reason to wait that long.

Why Amazon Workers’ Comp Claims Can Be Challenging

Whether the insurance companies and carriers raise Amazon’s workers’ compensation rates because of the high numbers of injuries or it is Amazon’s corporate policy, it can be difficult to make a claim for work related injuries while working for Amazon.

The insurance company may deny your claim entirely, or they may play hardball when it comes to covering medical care or negotiating a settlement. If you need help with your claim, you need an Amazon employee injury attorney to represent you in the process, especially if you are getting the red tape or the runaround.
